AC Project Hub End User License Agreement

This End User License Agreement governs authorized use of AC Project Hub, the Affordable Contracting, Inc. business management website, portal, communication system, and connected service integrations.

Authorized Users Employees, customers, vendors, subcontractors, and other users approved by Affordable Contracting.

Important legal notice

This EULA is intended for AC Project Hub and related Affordable Contracting systems. If a signed proposal, customer contract, written change order, employment agreement, subcontractor agreement, vendor agreement, purchase order, or other written agreement applies, that written agreement controls for that specific matter.

1. Acceptance of this EULA

This End User License Agreement ("EULA") is between Affordable Contracting, Inc. ("Affordable Contracting," "Company," "we," "us," or "our") and each person or entity that accesses or uses AC Project Hub, the Affordable Contracting website, portal, mobile or app-like experience, connected services, or related business systems ("System").

By accessing the System, accepting an invitation, creating an account, logging in, using a portal feature, sending a message, uploading content, approving a document, submitting a form, or using a connected integration, you agree to this EULA. If you do not agree, do not access or use the System.

2. Limited license to use AC Project Hub

Subject to this EULA and any role-based permissions assigned by Affordable Contracting, we grant you a limited, revocable, non-exclusive, non-transferable license to access and use the System only for authorized Affordable Contracting business purposes.

You do not receive ownership of the System, software, code, workflow design, database structure, forms, templates, reports, automations, branding, content, or any related intellectual property. Affordable Contracting may change, restrict, suspend, or discontinue features at any time.

3. Authorized users and role-based access

Access is limited to users approved by Affordable Contracting. Authorized users may include employees, managers, designers, foremen, installers, customers, vendors, subcontractors, administrators, owners, and other approved users.

Permissions are based on role, job assignment, customer or vendor relationship, subcontractor assignment, internal approval, and business need. A user may not access, attempt to access, copy, export, change, or share information outside that user's authorized role or assignment.

Never share your login, password, reset link, authentication code, device access, or portal invitation. Affordable Contracting may monitor login activity, device/browser information, IP information, and access attempts to protect company, customer, employee, vendor, and subcontractor records.

4. Portal records, monitoring, and business use

Messages, emails, notes, files, photos, videos, estimates, change orders, tasks, schedules, daily logs, time entries, purchasing records, job records, punch lists, approvals, customer portal activity, vendor portal activity, subcontractor portal activity, employee portal activity, and audit logs may be business records of Affordable Contracting.

The Company may monitor, review, preserve, export, archive, audit, summarize, route, or use System records for business, project management, quality control, customer service, scheduling, payroll, billing, accounting, safety, warranty, dispute, legal, compliance, training, and operational purposes.

The Portal Monitoring Notice provides additional information about monitoring and business record treatment.

5. QuickBooks, accounting, and financial data

AC Project Hub may connect with QuickBooks Online or other accounting, payment, banking, payroll, or job-costing services to help Affordable Contracting manage customers, vendors, estimates, invoices, payments, purchases, reports, job costing, and related business records.

QuickBooks and other accounting integrations are used for Affordable Contracting's internal business management and accounting workflows. The System does not provide legal, tax, investment, lending, banking, financial planning, payroll, or accounting advice to portal users.

Unless a specific owner-approved workflow says otherwise, QuickBooks is intended to remain the accounting source of truth for official accounting records. Any automatic or manual push-back of financial changes from the System to QuickBooks may be limited, logged, and subject to owner approval.

6. Third-party services and integrations

The System may use third-party services, APIs, or platforms, including QuickBooks/Intuit, Google/Firebase, Google Maps/Places, Microsoft 365/Graph, SendGrid, Twilio, Yelp, SerpAPI, Meta/Facebook/Instagram, Nextdoor, GoDaddy/cPanel, and other business tools.

Third-party services may have their own terms, privacy notices, availability limits, pricing, outages, account requirements, API restrictions, and data rules. Affordable Contracting is not responsible for third-party service failures, changes, downtime, API limits, security incidents, or rejected connections outside the Company's reasonable control.

7. Communications, approvals, and electronic records

The System may send or receive portal messages, emails, notifications, reminders, reset links, customer updates, vendor or subcontractor communications, employee communications, estimate notices, change-order notices, payment notices, and other business communications.

Depending on the feature used and the related written agreement, clicking an approval button, sending a message, signing electronically, submitting a form, approving an estimate, approving a change order, approving a punch-list item, or making a payment may create an electronic business record. Project-specific contract documents control whether a particular approval authorizes work, pricing, scheduling, or payment obligations.

8. Uploaded content, photos, and files

Users may be allowed to upload, submit, create, or attach photos, documents, videos, plans, messages, notes, receipts, invoices, warranties, punch-list items, material lists, product information, or other content. You represent that you have the right to submit that content and that it is accurate to the best of your knowledge.

By submitting content, you give Affordable Contracting permission to store, copy, display, process, route, archive, export, and use that content for authorized business, project, warranty, quality-control, customer service, marketing approval, legal, compliance, and operational purposes. Public marketing use of customer project photos or testimonials may be subject to additional approval workflows and applicable written terms.

9. Acceptable use rules

You agree that you will not:

  • Use the System for unlawful, deceptive, harassing, abusive, fraudulent, or unauthorized purposes.
  • Access, copy, modify, export, delete, or share data outside your authorized role or assignment.
  • Upload malware, malicious code, corrupted files, spam, misleading information, or content that violates another person's rights.
  • Attempt to reverse engineer, scrape, bypass security, disable logging, overload, damage, or interfere with the System.
  • Use another person's account, share your account, or allow an unauthorized person to use your access.
  • Misrepresent customer approvals, vendor approvals, subcontractor approvals, time records, purchases, job status, payments, or completion status.

10. Security and credential responsibilities

You are responsible for keeping your account credentials confidential and for promptly reporting suspected unauthorized access, lost devices, compromised passwords, suspicious messages, or incorrect portal permissions.

Affordable Contracting may require password resets, revoke invitations, restrict accounts, remove devices, disable sessions, review unusual login activity, or require additional verification when needed to protect the Company and its users.

11. Suspension, deactivation, and termination

Affordable Contracting may suspend, restrict, deactivate, or terminate access at any time, with or without notice, including for role changes, employment changes, project completion, vendor or subcontractor status changes, customer account closure, security concerns, suspected misuse, or business reasons.

Termination of access does not require Affordable Contracting to delete business records, accounting records, legal records, project records, audit logs, messages, files, photos, approvals, invoices, payments, or other records the Company is permitted or required to retain.

12. Disclaimers and no warranties

The System is provided for business management and communication purposes. To the fullest extent allowed by law, the System is provided "as is" and "as available" without warranties of uninterrupted access, error-free operation, complete accuracy, availability of third-party services, or fitness for any particular purpose.

Website content, portal content, estimates, schedules, maps, drive times, AI summaries, imported emails, imported reviews, OCR results, product information, job-costing views, and automated suggestions may require human review and may not be complete, current, or error-free.

13. Limitation of liability and indemnification

To the fullest extent allowed by law, Affordable Contracting is not liable for indirect, incidental, consequential, special, punitive, exemplary, lost-profit, lost-data, business-interruption, third-party, or unauthorized-access damages arising from use of the System.

You agree to defend, indemnify, and hold harmless Affordable Contracting, its owners, officers, employees, contractors, representatives, and affiliates from claims, losses, liabilities, damages, costs, and expenses arising from your misuse of the System, violation of this EULA, unauthorized access, submitted content, breach of confidentiality, violation of law, or violation of third-party rights.

14. Governing law, conflicts, and changes

This EULA is governed by the laws of the State of Florida, without regard to conflict-of-law rules. Unless another written agreement controls, venue for disputes related to this EULA will be in the state or federal courts serving Pinellas County, Florida.

If this EULA conflicts with a signed customer contract, written change order, employment agreement, subcontractor agreement, vendor agreement, purchase order, or other written agreement signed or approved by Affordable Contracting, the written agreement controls for that specific matter.

Affordable Contracting may update this EULA from time to time. Continued use of the System after an updated EULA is posted or provided means you accept the updated terms.
